Terms and Conditions of Sale for EBS Online Gift Shop

1. GENERAL PROVISIONS
1.1. These online shop’s (hereinafter ‘Online Shop’) terms and conditions of sale approved by SA Estonian Business School (hereinafter ‘Terms and Conditions’) apply to purchases made from the EBS Online Gift Shop at the address shop.ebs.ee. The seller of the merchandise is SA Estonian Business School, address A. Lauteri 3, 10114 Tallinn, registry code 90013934 (hereinafter ‘Seller’). The Terms and Conditions apply to transactions between anyone making a purchase from the EBS Online Gift Shop (hereinafter ‘Buyer’) and the Seller.
1.2. The Seller may unilaterally make changes in the Terms and Conditions of Sale, disclosing such changes in its online shop at: shop.ebs.ee/muugi-ja-tagastustingimused. If the Terms and Conditions of Sale are changed after a Buyer makes a purchase, the Buyer is subject to the Terms and Conditions of Sale applicable at the time of the purchase.
1.3. Before making a purchase the Buyer is required to read through and approve the Terms and Conditions of Sale; the Terms and Conditions of Sale can also be printed or otherwise saved, if necessary.
1.4. In addition to these Terms and Conditions the legislation applicable in the Republic of Estonia is also applied to purchases made from the Online Shop.
2. MAKING PURCHASES
2.1. The Buyer shall select the desired items from the Online Shop and add them to the cart. The Buyer shall select the desired product(s) from the EBS Online Gift Shop and add them to the cart.
2.2. The Buyer shall choose whether they want their merchandise to be delivered through the Omniva parcel machines network within the Republic of Estonia or pick the merchandise up at the address A. Lauteri 3, Tallinn.
2.3. The Buyer shall confirm the cart and pay for the merchandise either through a bank link to an Estonian bank or by credit card. Before paying an invoice the Buyer is required to verify that the details set out on the invoice correspond to the Buyer’s actual wishes.
2.4. After the Buyer has paid for their merchandise they must click on the link “Return to merchant”.
2.5. The Seller will e-mail the Buyer an order confirmation and the paid invoice.
2.6. A contract of sale between the Seller and the Buyer takes effect when the full purchase amount paid by the Buyer is received in the Seller’s bank account.
2.7. If a product purchased by the Buyer is out of stock, the Seller will refund the Buyer the cost of the product within 4 business days as of the making of the purchase, notifying the Buyer thereof at the first opportunity.
3. PRODUCT PRICE, PAYMENT OPTIONS
3.1. The prices of all merchandise sold in the EBS Online Gift Shop are in euros and include VAT.
3.2. If the Buyer chooses to pick up their merchandise themselves, no delivery cost will be charged in addition to the selling price. If the Buyer opts for delivery to an Omniva parcel machine, the delivery cost of €3.85 will be charged extra.
3.3. The EBS Online Gift Shop allows paying for merchandise either through a bank link to an Estonian bank or by credit card. A service fee may be charged in addition to the cost of the order according to the relevant contract between the customer and their bank or credit card issuer.
4. RECEIPT OF MERCHANDISE
4.1. You can request your merchandise to be delivered to the front desk at Estonian Business School at the address A. Lauteri 3, 10114 Tallinn, or to one of Omniva parcel machines across Estonia.
4.2. Picking up merchandise at the front desk at Estonian Business School.
4.2.1. You can pick up your merchandise on weekdays from 9:00 to 21:00 at the address A. Lauteri 3, 10114 Tallinn.
4.2.2. Merchandise is issued to the Buyer on the basis of the Buyer’s identity document (ID card, passport, driver’s license) and order number. The Seller has the right not to issue the merchandise if no identification is presented.
4.2.6. The Seller is not liable for any damage to the customer if, for reasons not attributable to the Seller, third parties have gained access to a copy of the invoice or the unique order number and have retrieved the goods on the basis thereof.
4.3. Retrieving goods from a parcel machine
4.3.1. If merchandise is delivered to the Omniva parcel machine of the customer’s choice, a delivery fee of €3.85 will be in addition to the price of the merchandise.
4.3.2. When the order has been dispatched, the Buyer will be notified thereof by e-mail no later than 2 business days after the order was placed.
4.3.3. When the merchandise has been delivered to the parcel machine the customer will be notified by an SMS which includes a unique door code to open the locker.
4.3.4. The Seller is not liable for any damage to the customer if, for reasons not attributable to the Seller, third parties have gained access to the unique door code for the parcel machine and have retrieved the goods on the basis thereof.
4.3.6. If the customer has not retrieved their merchandise from the parcel machine before the expiry of the storage deadline, the Seller deems that the customer has backed out of the order and the Seller will refund the customer the purchase amount without the delivery fee to the same bank account from which the purchase was paid for promptly but no later than within 14 calendar days.
